PREAMBLE
These Terms and Conditions of Sale and Use (hereinafter the "T&Cs") govern the contractual relationship between:
SAS BOUKOVSKA, a simplified joint-stock company with a share capital of €10,000, trading under the business name "Le Bar à Chaussettes".

Hereinafter referred to as "Le Bar à Chaussettes" or the "Seller",
and any natural person of full age acting for purposes that fall outside their commercial, industrial, craft, professional or agricultural activity, qualifying as a consumer within the meaning of the French Consumer Code, hereinafter referred to as the "Customer".

ARTICLE 1 – PURPOSE AND SCOPE
The purpose of these T&Cs is to define the conditions under which Le Bar à Chaussettes sells its products to consumers on the website www.lebarachaussettes.com. They also govern the general conditions of use of the website ("Terms of Use"). They apply to any order placed on the website, to the exclusion of all other conditions.
The applicable T&Cs are those in force on the date the order is placed. Le Bar à Chaussettes reserves the right to amend the T&Cs at any time; the version applicable to each transaction is retained and available on this page.
ARTICLE 2 – ACCEPTANCE OF THE T&Cs
Confirmation of the order by the Customer implies full and unreserved acceptance of these T&Cs. The Customer acknowledges having read the T&Cs before placing an order and expressly declares that they accept their terms by ticking the box provided for that purpose during the ordering process.
ARTICLE 3 – PRODUCTS AND AVAILABILITY
The products offered for sale are described and presented as accurately as possible. However, in the event of an error or omission in the presentation, Le Bar à Chaussettes cannot be held liable.
The photographs illustrating the products are not contractual documents. Despite the care taken in reproducing colours, variations may appear depending on the Customer's screen settings and calibration.
Product offers are valid while stocks last. If a product is unavailable after an order has been placed, Le Bar à Chaussettes informs the Customer by email as soon as possible and refunds the corresponding amount within fourteen (14) days.
ARTICLE 4 – PRICES
Product prices are shown in euros (€), inclusive of all taxes, excluding delivery costs. Delivery costs are specified to the Customer before the order is confirmed, depending on the delivery method chosen and the destination.
Le Bar à Chaussettes reserves the right to change its prices at any time; however, products ordered are invoiced at the price in force at the time the order is confirmed.
Value added tax. In accordance with article 259 D of the French General Tax Code and the intra-EU distance selling regime, French VAT is applied to all orders delivered in France and within the European Union for as long as the annual threshold of €10,000 (excluding tax) of turnover from intra-EU distance sales is not exceeded. If this threshold is exceeded, the applicable rate becomes that of the country of destination, in accordance with the regulations in force.
Deliveries outside the European Union. Deliveries to countries outside the European Union (in particular Switzerland, Norway, Andorra, Liechtenstein, San Marino, Gibraltar, the Isle of Man, the United States, Canada and Mexico) are made exempt from French VAT. Any customs duties and local taxes applicable on import (in particular local VAT) are payable by the Customer and collected by the customs authorities or the carrier upon import.
ARTICLE 5 – ORDERS
The Customer places an order by following these steps: selecting products and adding them to the basket, checking the contents of the basket, logging in or creating an account, choosing the delivery method, choosing the payment method, accepting these T&Cs, confirming and paying for the order.
The order is only definitively recorded once payment has been accepted by the banking institution and confirmed by email sent to the Customer at the address provided. This confirmation summarises the essential elements of the order (reference, products, price, delivery address) and serves as proof.
Le Bar à Chaussettes reserves the right to refuse or cancel any order in the event of an existing dispute with the Customer, non-payment, or legitimate grounds, in particular where the order is abnormal in view of the quantities usually ordered by a consumer.
ARTICLE 6 – PAYMENT
Payment is made online, at the time of ordering, by bank card (Carte Bleue, Visa, Mastercard, American Express) or by any other payment method offered on the website (PayPal, Apple Pay, etc.).
Transactions are secured by the payment providers Payplug SAS and PayPal (Europe) S.à r.l., which comply with the PCI-DSS standard. Bank card data is never stored by Le Bar à Chaussettes.
In the event of non-payment, Le Bar à Chaussettes reserves the right to suspend or cancel the order. The products remain the property of Le Bar à Chaussettes until the price has been paid in full to the Seller (retention of title clause).
ARTICLE 7 – DELIVERY AND TIMEFRAMES
Le Bar à Chaussettes delivers to mainland France, the European Union, Switzerland, Norway, Andorra and North America (United States, Canada, Mexico). The full list of available destinations and the rates in force are shown at checkout and detailed in the Shipping Policy.
Unless otherwise indicated at the time of ordering, products are dispatched within an indicative period of 1 to 3 working days after the order is confirmed. The delivery time runs from the moment the carrier takes charge of the parcel. Le Bar à Chaussettes undertakes to deliver within a maximum of thirty (30) days from confirmation of the order, in accordance with article L.216-1 of the French Consumer Code.
In the event of a delay in delivery attributable to the Seller and exceeding this period, the Customer may, after having given Le Bar à Chaussettes formal notice to deliver within a reasonable additional period and in the absence of performance, terminate the contract. The sums paid are then refunded within fourteen (14) days.
The Customer must check the condition of the parcel on delivery and immediately report any anomaly to the carrier and to Le Bar à Chaussettes by email at contact@lebarachaussettes.com.
ARTICLE 8 – RIGHT OF WITHDRAWAL
In accordance with article L.221-18 of the French Consumer Code, the Customer has a period of fourteen (14) days from receipt of the last item making up the order to exercise their right of withdrawal, without having to give reasons or pay any penalty. Le Bar à Chaussettes extends this period to thirty (30) days.
To exercise this right, the Customer notifies their decision to withdraw by an unambiguous statement, either directly from their customer account on lebarachaussettes.com (an acknowledgement of receipt is then sent to them by email), or using the model form appended to these T&Cs, to be sent by email to contact@lebarachaussettes.com or by post to: Le Bar à Chaussettes, 16 rue du Quai, 59800 Lille, France.
The products must be returned in their original condition, unworn and unwashed, with their original packaging and labels, within a maximum of thirty (30) days from notification of the decision to withdraw.
The direct costs of return are borne by the Customer, except in the event of a lack of conformity, an error or damage attributable to the Seller.
In accordance with article L.221-28 4° of the French Consumer Code, the right of withdrawal cannot be exercised for underwear (boxers, briefs, knickers, shorties) once its individual sealed packaging has been opened by the Customer, for hygiene reasons. Socks, on the other hand, remain fully subject to the right of withdrawal, provided they are returned unworn, unwashed, in their original packaging and with their labels.
Le Bar à Chaussettes refunds the Customer all sums paid for the returned products within fourteen (14) days of receiving the returned product or of the Customer providing proof of dispatch. The initial delivery costs (up to the amount of the standard delivery method) are refunded only where the withdrawal covers the entire order. In the event of a partial withdrawal, they remain due to the Seller, as delivery was carried out for the items kept. The refund is issued using the same payment method as the one used for the order, unless the Customer expressly agrees otherwise.
ARTICLE 9 – LEGAL GUARANTEE OF CONFORMITY
In accordance with articles L.217-3 et seq. of the French Consumer Code, Le Bar à Chaussettes guarantees that the products conform to the contract. The Customer has a period of two (2) years from delivery of the product to invoke this guarantee. During the first twelve months following delivery, any lack of conformity that appears is presumed to have existed at that date, unless proven otherwise.
In the event of a lack of conformity, the Customer may choose between repair or replacement of the product, subject to the cost conditions provided for in article L.217-9. If neither of these solutions is possible or available within one month of the claim, the Customer may request termination of the contract or a price reduction, in accordance with articles L.217-14 et seq.
Scope of the guarantee. The legal guarantee of conformity covers manufacturing defects, material defects, stitching defects, non-conformity with the product description, and size or colour not matching the order. In line with settled case law, it does not cover:
The Customer may send their claim to contact@lebarachaussettes.com, enclosing photographs and a description of the defect. Le Bar à Chaussettes replies within a maximum of fourteen (14) days.
ARTICLE 10 – GUARANTEE AGAINST HIDDEN DEFECTS
Independently of the legal guarantee of conformity, the Customer benefits from the guarantee against hidden defects provided for in articles 1641 to 1649 of the French Civil Code. Where there is a hidden defect making the product unfit for its intended use, or so impairing that use that the Customer would not have bought it, or would have paid a lower price, had they known, this guarantee allows the Customer to return the product and obtain a refund of the price, or to keep the product and obtain a partial refund of the price.
Action based on hidden defects must be brought within two (2) years of discovery of the defect.
ARTICLE 11 – RETURNS AND REFUNDS
The practical arrangements for returns, exchanges and refunds are described in the Return and Refund Policy, which forms an integral part of these T&Cs.
ARTICLE 12 – PERSONAL DATA
The processing of the Customer's personal data is governed by the Privacy Policy, which complies with Regulation (EU) 2016/679 (GDPR) and the French Data Protection Act.
ARTICLE 13 – CUSTOMER SERVICE
For any question, information or complaint relating to an order, the Customer may contact Le Bar à Chaussettes:

ARTICLE 14 – CONSUMER MEDIATION
In accordance with the provisions of the French Consumer Code on the consumer dispute mediation process, after having contacted us at contact@lebarachaussettes.com and in the absence of a satisfactory reply within two months, the Customer may refer the matter free of charge to a consumer mediation procedure with:

ARTICLE 15 – FORCE MAJEURE
Le Bar à Chaussettes cannot be held liable for the total or partial non-performance of its obligations where such non-performance results from a case of force majeure within the meaning of article 1218 of the French Civil Code (an event beyond the Seller's control, which could not reasonably have been foreseen when the contract was concluded and whose effects cannot be avoided by appropriate measures). The following in particular are considered cases of force majeure: strikes, exceptional weather conditions, natural disasters, fires, network or supply failures, armed conflicts, pandemics, and decisions of public authorities.
ARTICLE 16 – INTELLECTUAL PROPERTY
All the elements making up the lebarachaussettes.com website (the "Le Bar à Chaussettes" trademark, logos, texts, images, photographs, illustrations, videos, editorial content, graphic charter, website structure, database) are the exclusive property of SAS BOUKOVSKA or of its partners and are protected by French and international intellectual property law.
Any reproduction, representation, modification, publication, transmission or distortion, in whole or in part, of the website or its content, by any process whatsoever and on any medium whatsoever, is prohibited without the prior written authorisation of SAS BOUKOVSKA, and would constitute an infringement punishable under articles L.335-2 et seq. of the French Intellectual Property Code.
ARTICLE 17 – USE OF THE WEBSITE – PROHIBITED CONDUCT
The Customer undertakes to use the website in compliance with the laws and regulations in force. In particular, it is prohibited:
Any breach by the Customer of their obligations may result in the suspension or deletion of their customer account, without prejudice to any legal action that Le Bar à Chaussettes reserves the right to bring.
ARTICLE 18 – LIABILITY
Le Bar à Chaussettes is automatically liable to the Customer for the proper performance of the obligations arising from the distance contract, whether those obligations are to be performed by itself or by other service providers, without prejudice to its right of recourse against them, in accordance with article L.221-15 of the French Consumer Code.
However, Le Bar à Chaussettes may be released from all or part of its liability by providing evidence that the non-performance or improper performance of the contract is attributable either to the Customer, or to the unforeseeable and insurmountable act of a third party unconnected with the provision of the services, or to a case of force majeure.
Under no circumstances may Le Bar à Chaussettes be held liable for indirect damage resulting from use of the website, such as loss of business, loss of data or loss of profit, without prejudice to the Customer's rights under the legal guarantees.
ARTICLE 19 – PARTIAL INVALIDITY
If one or more provisions of these T&Cs are declared void or unenforceable under a law or regulation, or following a final decision of a court of competent jurisdiction, the remaining provisions retain their full force and effect.
ARTICLE 20 – APPLICABLE LAW AND JURISDICTION
These T&Cs and any order placed on the lebarachaussettes.com website are governed by French law.
In the event of a dispute, and before any legal action, the Customer is invited to seek an amicable solution by contacting Le Bar à Chaussettes (Article 13) and then, failing that, by referring the matter to the consumer mediator CM2C (Article 14).
Failing an amicable resolution, and in accordance with article R.631-3 of the French Consumer Code, the Customer may bring the matter, at their choice, before one of the courts having territorial jurisdiction under the French Code of Civil Procedure, or before the court of the place where they resided when the contract was concluded, or that of the place of actual delivery of the goods.
ARTICLE 21 – AMENDMENTS TO THE T&Cs
Le Bar à Chaussettes reserves the right to amend these T&Cs at any time. The applicable T&Cs are those in force on the date the Customer confirms the order. The most recent version is available at any time on this page. The date of the last update appears at the top of the document.
